For you, as well as for the salesman, this will cost the least amount of energy. No one gets mad, time isn’t spent on a disinterested person, no adrenaline, no arguing. It’s just smooth.

Sales people are thick skinned, or they don't stay in sales long. You can just tell them 'no thanks' and hang up and I promise you they'll forget about you in ten seconds flat.

Me: "I do not wish to answer your questions"
Sales: "Why?"
Me: "That is a question, I am sorry"
This works 10/10 times. You fuck up their flowcharts and sometimes they will hang up on you!

Interstate is handled on the federal level. I'm not sure how that is.

I work in sales that record our calls. If you are in a two party consent state. It would only record our line. So when we review the call recording. We can only hear what we say, not the other line.

If two party consent was required on a federal level, we probably wouldn't have one party consent states, unless it's a situation like marijuana where the federal law of two-pwrty consent is being ignored by the state.
I'd guess that federal law probably only requires one party consent, if federal law covers that at all. Could be wrong and states could just be choosing to ignore federal law for some reason, but I imagine that'd cause interstate issues with situations like that, where the recording party is in a one party consent state and calling someone who isn't.

California's Supreme Court has ruled that California's 2 party consent law applies to any call where at least 1 party is in California.
As far as I know, this hasn't been challenged at a higher level yet.

So if you want to imagine it, they are people. They generally respond the way people do. Presumably you are a person as well so maybe imagine how you would react. If I told you that I have decided to charge you for your replies are you really going to hand over your credit card information and start haggling on a price?

You have quite the imagination. I don’t think a conversation with a real person would ever go like this.

Exactly.
I run a business, and as such anybody is allowed to call me to request service or offer their service. Over the course of more than a decade I have come to the conclusion that the fastest way to end a sales pitch is simply to say, "Sorry to interrupt you, but I am not interested in that. Have a pleasant day." And then hang up. Sometimes I can hear they continue to pitch after my goodbye, but that's their problem.
Some sales persons call excessively often, in which case I ask them to take note about not to call again, or they accept to be invoiced for half an hour of my time for each additional call. Nobody has called back again after that message.

When saying take me off your list does nothing after the 78th time, just hangup instantly and block. Adaptation. It saves my time as well as theirs. If every second counts in sales they don't want to be on the line with me any longer than they need to
3 points

well, there's a lot of factors. i used to work in a pharmacy call center for one of the big chains. there are a lot of regulations on call center calls. a reputable place will put you on a DNC list (provided the rep who called you followed through- mistakes happen). there's fines for calling people outside of reasonable times (9am-8pm local time for the recipient), calling an excessive amount of times per day (i think it was 4-5x in a single day) and notifying of a recorded line immediately upon introducing the purpose of the call.
scummy places though, yeah. they probably wont take you off the DNC list
4 points

Yeah I say this every 3 months or so to the same company and they still keep calling multiple times a day. I evaluated how muh i actually use my phone for calls and now I just have it set up to ignore every call that isn't in my contacts list. Much better, and anyone who I care about can still reach me if they need to.

My script is, “Please put me on your ‘do not call’ list.” Often they hang up then, but just as often they thank me and then hang up. The wording is chosen to match with the US Telecommunications Privacy Act to maximize compliance.

Yeah….when they come to my door I stand at the window and look at them. They stand there and wave and I wave back. I then walk away and they will still ring/knock on the door. I’ve even stood there with my dog barking for 5 minutes before they left. I sometimes open the window and then close once pleasantries have been made. It’s kinda funny, imo, but I don’t really wanna talk about god/washing windows/bug spraying/name something.

I have an on-call cell for work. I would occasionally get spam calls on it when I first got it. I started telling everyone who called “sorry, this is a call phone for a medical lab. So much so, in fact, that I started saying the same thing to calls on my personal phone, which also put an end to those calls on my personal phone.

Politeness.
I wouldn't take OP's advice because I don't like being being untruthful and avoidant. You're just hiding from the confrontation of having to say no and maybe become a bit assertive so that they get that I am not interested.
Lying and then blocking, or even just hanging up, might be easier. But it's avoidant and equivalent to something like staying quiet and hiding when someone rings the doorbell. Well not exactly that, imagine I came up with a better example instead.
I just don't wanna be that person. And if they don't stop pitching when I've politely declined, I will say no more aggressively, and if that doesn't work I will hang up.
5 points
There’s absolutely no reason to be polite to someone who sees you only as a mark. Hanging up and blocking the number wastes the least amount of my time.
Same thing when someone rings the doorbell. I got a camera doorbell so I can see exactly who’s there. If it’s not someone I know, or someone I’m expecting, I don’t even get up. Well, unless it’s an attractive woman. Maybe.

What power does the GDPR have on indian firms?
20 points
GDPR applies to EU citizens to protect their data. As long as any company anywhere wants to engage EU citizens in transactions or to process their data, they need to follow the GDPR principles, or to completely exclude EU citizens from their business. That's why when GDPR came into effect, some US companies (ie news websites and magazines) chose to block EU citizens from accessing their websites hosted in US, because the companies (outside of EU) would then be obligated to follow the GDPR for how they are tracking EU visitors and using their data for advertising etc. and they didn't want to do that (possibly because they didn't want to change their processes and revenue streams from selling customer data, which would be a massive no-no under GDPR). It's the same way that foreign countries doing business with US, although not incorporated in US, need to follow US' laws for privacy, export limitations etc.
Jurisdiction is not as simple as "company not registered in EU, the EU laws do not apply". There are lots of complex rules for doing business internationally - just as an example, if a US company does business that exceeds $10,000 per year in one of the EU countries, the company must register for VAT purposes in that country, to report sales to the local government, to collect VAT and taxes and pay them in that country, even if they do not create a separate legal entity there. And they'll have to do that for each of the almost 30 EU countries as long as each country exceeds this $10k limit/year/country.

I think he’s talking about indian call centres engaging in scams. They’re already doing fraud and obfuscating their phone numbers, the GDPR isn’t going to be a deterrent for them
2 points

The same can be said about some pissed off kid walking in school one day with a heavy backpack, and how much the laws concerning homicide and gun control will not be able to stop the bullets. Laws are for the people inclined to follow them; when they decided otherwise, no piece of paper will be of any use.

His question was what power the GDPR had over Indian scammers. If you were a law student, you’d be smart enough to say none.

You people are answering? Any time I get a call from a number I don't know, I just decline it to voicemail. If they don't leave one, it obviously wasn't important, and blocked. Simple, easy, and doesn't require me to talk to anyone.

As soon as I understand it is an unsolicited sales call I just say in a pleasant tone “Thankyou but I’m not interested, Bye.” I hang up immediately without giving them chance to say anything else and block them. That seems both polite enough and efficient use of my time…

Not only is it an efficient use of my time, it seems to me like it's an efficient use of their time. Their job requires them to be pushy, but I'm not going to buy their stuff, so the last thing they want me to do is be polite and listen to them when it's just a waste of time for both parties.

Please take my number off your calling list please. Thank you.... And never hang up first make them do it. This way they gotta press the button on the screen that says interested, call back later, or remove number.
Worked a call center for charity's and all you did was read the text and press one of the few buttons to categorize the person. 99% of the time you hit the call back later cause screw you buddy you didn't have to say that I'm just doing my job. But legally we had to remove the number if you said that exact phrase in a nice calm manner. Once you curse you are belligerent and will get a call back later.

You don't even need to do that. As soon as you recognize what the call is, hang up. Don't bother speaking or engaging, you're just wasting your own time.
Trying to disrupt their scripts is unnecessary. All their work is recorded, they have to speak with you as long as you remain on the line, and their jobs are fucking awful anyway. Hanging up is the best thing you can do for either of you.

People answer calls from numbers they don’t know? I ignore every number not in my contacts and if they don’t leave a message they get immediately blocked. If they leave a message and it is a sakes/spam call I block. If it is someone I want to talk to I add them to my contacts and call them back.

Let the call stop and immediately block them is my way, I'm too lazy to even pick the call lol.

Or just say you are not interested and ask yo be removed from the list. Doing this means in my job I have to call you five more times before I am allowed to remove you and it clogs my system up with useless busy work.

Or hang up and block without saying anything???

They will simply call you from another number.

I just say:we don't do any telemarketing, thank you for calling. And then hang up gently. Sometimes it is amusing to hear that they are not telemarketing, then they realize the silliness of their argument and hang up themselves. I am sure I get removed from call lists, as I certainly get less calls now.

Here is the best method. Pick up the phone and you say hello in a soon as you realize it’s someone calling that is unsolicited that is looking to waste your time possibly scam you out of money, and it’s disturbing you, don’t just hang up. Simply say like let’s say they ask for the head of the household, just say one moment please, quietly sit down the phone and continue doing whatever you were doing. Whether you were cooking, watching TV, doing something on your phone or computer. Eventually you’ll hear the dial tone of the phone and sometimes that happens within seconds but I’ve had it happen like for five or 10 or 20 minutes and I get such joy! Sometimes I’ll even hear them say hello or say something after a few minutes… I won’t say anything but wait until they hung up before I hang up my phone or just randomly hangup my phone after a few minutes. What does this do?
This effectively wastes their time just as they had no care about wasting mine. I probably just saved five other people from being scammed that day because of the five or 10 minutes I wasted. And I have almost never gotten a call back from that same company or at least not within the same day. There’s no way they’re going to call back and waste another 20 minutes!
But on the real time they do, I either just let it go to voicemail, or I pick up again and say one moment please and put them on hold again. They never call back a 3rd time, lol. NEVER

Sometimes the way to achieve peace and tranquility is not to engage in unnecessary battles, especially those that have no impact on our lives - not even worth the negative energy it generates.

So former insurance salesman here, the best system I know was to politely request they remove you from the dialler and system.
Some companies have multiple caller IDs so blocking doesn’t always work and telling them to call you back puts your number in the responsive data pool so you’ll get a call from them again or another subsidiary within that company.

But what about waiting 5 seconds in and they’re mid flow and you just Hang up on them 👀

I just don’t engage. The second I realize it’s a sales call… click. If I say hello and there’s no immediate response… click. The moment the person asks how I am doing today… click. They aren’t paying to occupy space in my head beyond that.

You block them and they call you with another number, I'm getting around 5 calls each day from numbers that my phone classified as spam and block them every day

Or, due to number spoofing and computerized auto diapers when this trick actually increases the number of spam calls from Phone salesmen, just don’t answer and don’t send to voicemail. Let it ring out.
Auto dealers are usually paired to multiplier systems and respond by if someone picks up before X rings. Turn off your voicemail box for a couple weeks, let these calls go unanswered and you’ll see the number of calls drop significantly

Or just happily call them out. Idk why someone would ever pretend to be nice to those callers( scammers).

Politely say you’re not interested and then hang up without waiting for a response.
If you can’t stand up for yourself then you get what you deserve.
